RELEASE OF LIABILITY, WAIVER OF CLAIMS, INDEMNITY AND
ASSUMPTION OF RISKS AGREEMENT
(“Release Contract and Consent”)
BY SIGNING THIS RELEASE CONTRACT AND CONSENT, YOU ARE WAIVING OR GIVING UP LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT.
READ THIS DOCUMENT CAREFULLY BEFORE SIGNING IT!
In this Release Contract and Consent, “Releasees” means, collectively, Campus Athletics Inc. and its associated companies and subsidiaries, and their respective employees, instructors, coaches, agents, servants, independent contractors, subcontractors, representatives, volunteers, sponsors, successors and assigns.
ASSUMPTION OF RISKS
Personal training, crossfit, bootcamp, lifting and other various forms of physical activity, including without limitation the use of facilities and equipment such as barbells, dumbbells, pullup bars, kettle bells, jump ropes and other fitness equipment (herein collectively referred to as “Personal Training”), like all physical activity, exposes you to the risk of serious injury. When using our facilities or equipment, you assume the risk of any injury that may occur. Our liability for all injury or loss is excluded by the terms of this Release Contract and Consent.
Injuries are a common and expected part of Personal Training. The use of our facilities and equipment exposes you to many risks, dangers and hazards. These include but are not limited to: mechanical failure of equipment; falls; physical injury; use of fitness equipment; negligence of other users of our facilities; adverse reaction to flash photography; and NEGLIGENCE ON THE PART OF THE RELEASEES, INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT YOU FROM THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH PERSONAL TRAINING.
You control the degree of risk you will encounter in using our facilities and equipment. Do not attempt any activities at our facility unless you have sufficient ability and skill to do so safely. Always act within your ability level. We retain the absolute and sole discretion to ask for you to leave our facility or stop participating at any time, although we have no obligation or responsibility to do so.
I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH PERSONAL TRAINING AND I FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS RESULTING THEREFROM.
RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT
As a condition of use of Campus Athletics Inc. facilities and by signing this Release Contract and Consent, I, for myself, my heirs, executors, administrators, successors and assigns:
WAIVE ANY AND ALL CLAIMS I have or may have in the future against the Releases, AND TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in Personal Training or other physical activities DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT OF BRITISH COLUMBIA, ON THE PART OF THE RELEASEES, AND FURTHER INCLUDING THE FAILURE ON THE PART OF THE RELEASEES TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF PERSONAL TRAINING OR OTHER PHYSICAL ACTIVITIES.
INDEMNIFY AND HOLD HARMLESS the Released from any and all losses, demands, damages, claims and actions arising directly or indirectly in any matter whatsoever in connection with my participation in Personal Training or other physical activities, and shall pay all of the Releases' costs and expenses, including lawyer costs, in connection with any such demand or claim.
ASSUME FULL FINANCIAL LIABILITY and shall compensate Campus Athletics Inc. for any damage to facilities, furniture and equipment, or the loss of furniture or equipment when caused by negligent or abusive treatment.
GENERAL
In entering into this Release Contract and Consent I am not relying on any oral or written representations or statements made by the Releasees with respect to the safety of Personal Training or other physical activities, other than what is set out in this Release Contract and Consent. I agree that any litigation involving the Releasees shall be brought solely within the Province of British Columbia and shall be within the exclusive jurisdiction of the Courts of the Province of British Columbia. I further agree that these conditions and any rights, duties and obligations as between the Releasees and me shall be governed by and interpreted solely in accordance with the laws of the Province of British Columbia and no other jurisdiction. If any provision of this Release Contract and Consent is declared or held to be invalid for any reason, that invalidity will not affect the validity of the remainder of this Release Contract and Consent, which shall continue in full force and effect.
PHOTOGRAPHIC, VIDEO AND AUDIO RECORDING CONSENT
When you enter the gym portion of our facilities, YOU MAY BE PHOTOGRAPHED, FILMED OR RECORDED for purposes including providing you with training, coaching and other Campus Athletics Inc. services. Absolutely no photography, filming or recording is conducted in washrooms or changing rooms.
Campus Athletics Inc. uses photographic, video and audio recordings of you for the purpose of providing you with training, coaching and other Campus Athletics Inc. services. We will not use this information for any other purpose without your consent.
Campus Athletics Inc. will not share photographic, video or audio recordings of you with anyone outside our organization, or for any promotional or advertising purpose, without your consent.
By using our facilities and signing this Release Contract and Consent, you consent to our collection, use and disclosure of photographic, video and audio recordings of you in accordance with this Release Contract and Consent, and our Privacy Policy. If you have any questions about photography, video or audio recording in our facilities, please do not hesitate to ask us at any time.
